Privacy Policy
This Privacy Policy sets out the rules for the processing of personal data obtained through the online store www.Eyeon.design (hereinafter referred to: "Online Store"). The owner of the Store and, at the same time, data administrators is Katarzyna Żebrowska, Piotr Horyza conducting business activity under the name Eye on Design K.Żebrowska P.Horyza s.c. based in Warsaw (02-769), Puławska 257/86, NIP: 5213894685, Regon: 385855520, hereinafter referred to as Eyeon.design. Personal data collected by Eyeon.design through the Online Store are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also known as RODO. Eyeon.design takes special care to respect the privacy of Customers visiting the Online Store.
§1
Type of data processed, purposes and legal basis:
Eyeon.design collects information on natural persons performing a legal action not directly related to their activities, natural persons conducting business or professional activities on their own behalf, and natural persons representing legal persons or organizational units that are not legal persons, to which the law grants legal capacity, hereinafter collectively referred to as Clients. Customers' personal information is collected for the purpose of:
a) registration of an account in the Online Store, in order to create and manage an individual account. Legal basis: necessary for the performance of the contract for the provision of the Account service (Article 6(1)(b) of the DPA);
b) Placing an order on the Online Store, in order to perform the sales contract. Legal basis: necessary for the performance of the sales contract (Article 6(1)(b) of the DPA);
c) Subscription to a newsletter (Newsletter), for the purpose of performing a contract the subject of which is a service provided electronically. Legal basis - consent of the data subject to perform the contract for Newsletter service (Article 6(1)(a) RODO).
3. When registering an account with the Online Store, the Customer provides:
a) email address;
b) address details:
b.1) zip code and city;
b.2) country (state);
b.3) Street including house/apartment number.
c) name;
d) phone number.
4. When registering an account with the Online Store, the Customer independently sets an individual password to access his/her account. The Customer may change the password, at a later time, according to the rules described in §5.
5. When placing an order on the Online Store, the customer provides the following data:
a) email address;
b) address details:
b.1) zip code and city;
b.2) country (state);
b.3) Street including house/apartment number.
c) name;
d) phone number.
6. For Entrepreneurs, the above scope of data is further expanded to include:
a) Entrepreneur's company;
b) tax ID number.
7. In the case of using the Newsletter service, the customer provides only his e-mail address.
8. When using the Store's Website, additional information may be collected, in particular: the IP address assigned to the Customer's computer or the external IP address of the Internet provider, domain name, browser type, access time, type of operating system.
9. Navigation data may also be collected from Customers, including information about the links and references they choose to click on or other actions they take on the Online Store. Legal basis - legitimate interest (Article 6(1)(f) RODO), consisting of facilitating the use of services provided electronically and improving the functionality of such services.
10. For the purpose of establishing, investigating and enforcing claims, certain personal data provided by the Customer as part of the use of functionality on the Online Store may be processed, such as name, surname, data on the use of services, if claims arise from the way the Customer uses the services, other data necessary to prove the existence of the claim, including the extent of the damage suffered. Legal basis - legitimate interest (Article 6(1)(f) of the RODO), consisting in the establishment, investigation and enforcement of claims and defense against claims in proceedings before courts and other state authorities.
11. Provision of personal data to Eyeon.design is voluntary, in connection with the conclusion of contracts of sale or provision of services through the Store's Website, with the proviso, however, that failure to provide the data specified in the forms in the Registration process prevents the Registration and establishment of a Customer Account, and in the case of placing an order without the Registration of a Customer Account will prevent the placement and processing of the Customer's order.
§2
To whom is the data shared or entrusted and how long is it kept?
The Customer's personal data is transferred to the service providers used by Eyeon.design in the operation of the Online Store. Service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, are either subject to Eyeon.design's instructions as to the purposes and methods of processing such data (processors) or independently determine the purposes and methods of processing (administrators).
a) Processors. Eyeon.design uses suppliers who process personal data only at Eyeon.design's direction. These include, but are not limited to, vendors providing hosting services, accounting services, providing systems for marketing, systems for analyzing traffic
on the Online Store, systems for analyzing the effectiveness of marketing campaigns;
b) Administrators. Eyeon.design uses suppliers who do not act solely on instructions and determine for themselves the purposes and uses of customers' personal data. They provide electronic payment and banking services.
2. Location. Service providers are located in Poland and other countries in the European Economic Area (EEA).
3. Customers' personal data are stored:
a) If the basis for the processing of personal data is consent then the Client's personal data is processed by Eyeon.design as long as the consent is not revoked, and after revoking the consent for a period of time corresponding to the period of limitation of claims that Eyeon.design may raise and that may be raised against it. Unless a special provision provides otherwise, the statute of limitations is six years, and for claims for periodic benefits and claims related to the conduct of business - three years.
b) If the basis of data processing is the performance of a contract, then the Customer's personal data are processed by Eyeon.design for as long as it is necessary for the performance of the contract, and after that for a period corresponding to the period of limitation of claims. Unless a special provision provides otherwise, the statute of limitations is six years, and for claims for periodic benefits and claims related to the conduct of business - three years. If you make a purchase from the Online Store, your personal data may be transferred to a courier company or wholesalers cooperating with the Seller to deliver the ordered goods. Navigation data may be used to provide better service to customers, analyze statistical data and customize the Online Store to customers' preferences, as well as administer the Online Store. If the Customer subscribes to a newsletter (Newsletter), Eyeon.design will send electronic messages containing commercial information about promotions and new products available
in the Online Store to the Customer's e-mail address. If a request is made, Eyeon.design shall make personal data available to authorized state authorities, in particular to organizational units of the Prosecutor's Office, the Police, the President of the Office of Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications. Eyeon.design uses "cookies" and similar technologies - hereinafter collectively referred to as
Cookies. Data will be processed by automated means, including marketing profiling, The legal basis for the collection of data for marketing purposes read from Cookies is Article 6(1)(f) of the RODO, allowing the processing of personal data for the realization of the legally justified interest of the data controller. Depending on which Cookies have been accepted by the Client, the above justified purposes for which data read from Cookies are used include:
a) To ensure the proper and safe operation of the Store for the Customer and its device;
b) Assistance to Customers for efficient navigation of the Store - customization of the Store's Service to individual settings of the User and remembering the data entered by the User related to the use of the Service, e.g. the choice concerning the storage of Cookies;
c) to perform various functions, including traffic analysis - conducting statistical analysis of customers visiting the Store, such as site visit statistics, which will be used to improve the effectiveness of Eyeon.design's marketing activities and build business strategy;
d) advertising and promotion, distribution of information and advertising materials through the Store.
9. The data are processed until the purposes of their collection (indicated above) are achieved, or until an effective objection is made to their processing, or until the Cookies are deleted from the terminal device used by the Customer when connecting to the Store - depending on which event occurs first. Some functions of Cookies allow us to collate Customers' personal data and create statistics and summaries from them, which we may later use in order to adjust the content provided to Customers accordingly. In connection with the compilation of analyses and statistics, Customer profiling may occur, i.e. the creation of a profile containing information about the Customer's interests. At the same time, we inform you that decisions based on the created profiles will not be made in an automated manner. For more information about Cookies, including management and deletion of Cookies, see § 3.
§3
Cookie mechanism, IP address
The Online Store uses small files, called cookies. They are stored by Eyeon.design on the end device of a visitor to the Online Store, if the Internet browser allows it. A cookie usually contains the name of the domain from which it originated, its "expiration time" and an individual, random number that identifies the cookie. The information collected through cookies of this type helps tailor the products offered by Eyeon.design to the individual preferences and actual needs of visitors to the Online Store. They also give the possibility to develop general statistics of visits to the presented products in the Online Store. Eyeon.design uses two types of cookies:
a) Session cookies: when the session of a particular browser ends or the computer is turned off, the stored information is deleted from the device's memory. The mechanism of session cookies does not allow the collection of any personal data or any confidential information from Customers' computers.
b) Persistent cookies: they are stored in the memory of the Customer's terminal device and remain there until they are deleted or expire. The mechanism of persistent cookies does not allow the collection of any personal data or any confidential information from the Clients' computer. Eyeon.design uses proprietary cookies for the following purposes:
a) Authentication of the Client in the Internet Shop and providing the Client's session in the Internet Shop (after logging in), thanks to which the Client does not have to re-enter his/her login and password on each sub-page of the Internet Shop;
b) analysis and research, as well as audience auditing, and in particular to create anonymous statistics that help to understand how customers use the Store's Website, which allows to improve its structure and content.
4. Eyeon.design uses external cookies for:
a) collection of general and anonymous statistical data through Google Analytics analytical tools (third-party cookie administrator: Google Inc. based in the USA);
5. The mechanism of cookies is safe for the computers of Customers of the Online Store. In particular, by this means it is not possible for viruses or other unwanted software or malware to get into Customers' computers. However, in their browsers, Customers have the option to limit or disable the access of cookies to their computers. If this option is used, the use of the Online Store will be possible, except for functions that by their nature require cookies.
6. Here's how you can change the settings of popular web browsers regarding the use of cookies:
a) Internet Explorer browser;
b) Microsoft EDGE browser;
c) Mozilla Firefox browser;
d) Chrome browser;
e) Safari browser;
f) Opera browser.
7. Eyeon.design may collect IP addresses of Customers. An IP address is a number assigned to the computer of a person visiting the Online Store by an Internet Service Provider. The IP number allows access to the Internet. In most cases, it is assigned to the computer dynamically, i.e. it changes each time you connect to the Internet. The IP address is used by Eyeon.design to diagnose technical problems with the server, to create statistical analysis (e.g. to determine from which regions we record the most visits), as information useful for administration and improvement of the Internet Shop, as well as for security purposes and possible identification of unwanted automatic programs overloading the server and used for browsing the contents of the Internet Shop.
8. The online store contains links and references to other websites. Eyeon.design is not responsible for the privacy policies on them.
§4
Rights of data subjects
Right to revoke consent - legal basis: Article 7(3) of the RODO.
a) The customer has the right to revoke any consent given by eyeon.design
b) Withdrawal of consent has effect from the moment of withdrawal of consent.
c) Withdrawal of consent does not affect the processing carried out by Eyeon.design in accordance with the law before its withdrawal.
d) Withdrawal of consent does not entail any negative consequences for the Client, however, it may prevent further use of services or functionalities that Eyeon.design can legally provide only with consent.
2. The right to object to the processing of data - legal basis: article 21 RODO.
a) The customer has the right to object at any time - for reasons related to his/her particular situation - to the processing of his/her personal data, including profiling, if Eyeon.design processes his/her data on the basis of a legitimate interest, such as marketing Eyeon.design's products and services, keeping statistics on the use of particular functionalities of the Online Store and facilitating the use of the Online Store, as well as satisfaction surveys.
b) Opting out in the form of an e-mail from receiving marketing communications regarding products or services will imply the Customer's objection to the processing of his/her personal data, including profiling for these purposes.
c) If the Client's objection proves to be valid and Eyeon.design has no other legal basis for processing personal data, the Client's personal data will be deleted, against the processing of which, the Client has objected.
3. Right to erasure of data ("right to be forgotten") - legal basis: Article 17 of the RODO.
a) The customer has the right to request the deletion of all or some personal data.
b) The customer has the right to request deletion of personal data if:
b.1) personal data are no longer necessary for the purposes for which they were collected or for which they were processed;
(b2) withdrew specific consent, to the extent that personal data was processed based on his consent;
b.3) has objected to the use of his or her data for marketing purposes;
b.4) Personal data is processed illegally;
b.5) personal data must be deleted in order to comply with a legal obligation under Union or Member State law to which Eyeon.design is subject;
b.6) personal data was collected in connection with offering information society services.
c) Despite a request for deletion of personal data, due to the filing of an objection or withdrawal of consent, Eyeon.design may retain certain personal data to the extent that the processing is necessary to establish, assert or defend claims, as well as to comply with a legal obligation requiring processing under Union law or the law of a Member State to which Eyeon.design is subject. This applies in particular to personal data including: first name, last name, e-mail address, which data are retained for the purpose of handling complaints and claims related to the use of Eyeon.design's services, or additionally, home address/address for correspondence, order number, which data are retained for the purpose of handling complaints and claims related to concluded sales contracts or provision of services.
4. The right to restrict data processing - legal basis: article 18 RODO.
a) The customer has the right to request restriction of processing of his/her personal data. Submitting a request, until it is considered, prevents the use of certain functionalities or services, the use of which will involve the processing of data covered by the request. Eyeon.design will also not send any communications, including marketing communications.
b) The customer has the right to request a restriction on the use of personal data in the following cases:
b.1) when he or she questions the accuracy of his or her personal data - then Eyeon.design restricts their use for the time needed to verify the accuracy of the data, but no longer than for 7 days;
b.2) When the processing of data is unlawful, and instead of deleting the data, the Customer requests a restriction on its use;
b.3) When the personal data is no longer necessary for the purposes for which it was collected or used but is needed by the Customer to establish, assert or defend claims;
b.4) when he or she has objected to the use of his or her data, in which case the restriction shall be for the time necessary to consider whether, due to the particular situation, the protection of the Client's interests, rights and freedoms outweighs the interests pursued by the Administrator in processing the Client's personal data.
5. Right of access to data - legal basis: article 15 of RODO.
a) The Customer has the right to obtain confirmation from the Administrator as to whether it is processing personal data, and if this is the case, the Customer has the right:
a.1) gain access to your personal information;
a.2) obtain information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients of such data, the planned period of storage of the Customer's data or the criteria for determining this period (when it is not possible to determine the planned period of data processing), the Customer's rights under the RODO and the right to lodge a complaint with a supervisory authority, the source of such data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of such data outside the European Union;
a.3) obtain a copy of your personal data.
6. Right to rectification of data - legal basis: article 16 of RODO.
a) The Customer has the right to request from the Administrator the immediate rectification of personal data concerning him/her that is incorrect. Taking into account the purposes of the processing, the Customer to whom the data pertains has the right to request the completion of incomplete personal data, including by providing an additional statement, by addressing the request to the e-mail address in accordance with §6 of the Privacy Policy.
7. Right to data portability - legal basis: article 20 of RODO.
a) The Client has the right to receive his/her personal data, which he/she has provided to the Administrator, and then send it to another personal data controller of his/her choice. The Customer also has the right to request that the personal data be sent by the Administrator directly to such an administrator, if technically possible. In such a case, the Administrator will send the Customer's personal data in the form of a file in csv format, which is a commonly used, machine-readable format that allows sending the received data to another personal data controller.
8. In a situation where the Client has asserted an entitlement under the above rights, Eyeon.design shall meet the request or refuse to meet it immediately, but no later than within one month after receiving it. However, if - due to the complicated nature of the request or the number of requests - Eyeon.design will not be able to fulfill the request within one month, it will fulfill it within another two months informing the Client in advance - within one month of receiving the request - of the intended extension of the deadline and the reasons for it.
9. The customer may report complaints, inquiries and requests to the Administrator regarding the processing of his personal data and the exercise of his rights. Contact the Administrator: hello@eyeon.design
10. The customer has the right to request Eyeon.design to provide a copy of the standard contractual clauses by directing the request in the manner indicated in §6 of the Privacy Policy.
11. The customer has the right to lodge a complaint with the President of the Office for Personal Data Protection regarding violation of his/her data protection rights or other rights granted under the RODO.
§5
Security management - password
Eyeon.design provides Customers with a secure and encrypted connection when transferring personal data and when logging into the Customer's Account on the Website. Eyeon.design uses an SSL certificate issued by one of the world's leading companies in the field of security and encryption of data transmitted over the Internet. In the event that a customer with an account in the Store lost his access password in any way, the Online Store allows you to generate a new password. Eyeon.design does not send a password reminder. The password is stored in the database in an encrypted form in such a way that it cannot be read. In order to generate a new password, you need to provide your e-mail address in the form available under the link "You forgot your password", provided at the login form for your account in the Online Store. The new password will be automatically sent to the e-mail address provided during registration or saved in the last account profile change. Eyeon.design never sends any correspondence, including electronic correspondence, asking for login credentials, especially the password to access the Customer's account.
§6
